These Terms and Conditions set out the basis on which Waste Clearance Harrow provides waste removal and related services to residential, commercial, and other customers in our operating area. By booking or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

1.1 "Company" means Waste Clearance Harrow, the waste collection and clearance service provider supplying the services described in these Terms and Conditions.

1.2 "Customer" means any individual, business, organisation, or other entity that requests, books, or receives services from the Company.

1.3 "Services" means waste collection, waste clearance, rubbish removal, recycling, and any associated services carried out by the Company.

1.4 "Booking" means a confirmed request for Services made by the Customer and accepted by the Company, whether by telephone, email, online form, or any other agreed method.

1.5 "Waste" means any items, materials, or substances the Customer asks the Company to remove, including household, garden, construction, commercial, and bulky waste, subject to the exclusions and regulations set out in these Terms and Conditions.

1.6 "Service Area" means the geographic area in which the Company operates and offers waste clearance and waste collection services, including Harrow and surrounding locations as determined by the Company from time to time.

2. Scope of Services

2.1 The Company provides waste clearance and waste collection services within its Service Area, subject to vehicle access, site conditions, safety, and compliance with applicable laws and regulations.

2.2 The Company reserves the right to decline any job or any type of Waste at its sole discretion, including where the Waste is hazardous, prohibited, improperly described, or otherwise unsuitable for collection.

2.3 The Company will use reasonable care and skill in providing the Services, but does not guarantee that all Waste will be removed if it exceeds the agreed volume, weight, or type described at the time of Booking.

3. Booking Process

3.1 Customers may request Services by contacting the Company via telephone, email, or online booking form. The Customer must provide accurate details regarding the type, quantity, and location of Waste, as well as access conditions and any relevant site information.

3.2 A Booking is only confirmed when the Company accepts the request and provides a confirmation, which may include an estimated price, proposed service date, and any specific conditions.

3.3 The Customer is responsible for ensuring that all information provided at the time of Booking is accurate and complete. Failure to disclose relevant information, such as restricted access, parking constraints, or the presence of hazardous or heavy items, may result in additional charges, delays, or cancellation of the Services.

3.4 The Company reserves the right to amend or refuse a Booking if the scope of work or type of Waste differs materially from the information provided by the Customer at the time of the original enquiry.

4. Service Attendance and Access

4.1 The Company will use reasonable efforts to attend the Customer's property or site on the agreed date and within the agreed time window. However, all dates and times are estimates and are not guaranteed. The Company will not be liable for any loss or inconvenience caused by delays that are outside its reasonable control.

4.2 The Customer must ensure that the Company has clear, safe, and lawful access to the Waste at the agreed time. This includes arranging any necessary parking, permits, security clearances, and access through common areas, gates, or shared driveways.

4.3 Where parking or access restrictions apply, the Customer must inform the Company in advance. Any parking fees, penalties, or additional costs incurred due to lack of information or restricted access may be charged to the Customer.

4.4 If the Company is unable to carry out the Services on arrival due to lack of access, unsafe conditions, or missing authorisation from the Customer or their representative, the Company may charge a call-out fee or apply its cancellation terms.

5. Waste Description and Excluded Items

5.1 The Customer must accurately describe the Waste for collection, including its general type, estimated quantity, and any unusual characteristics such as bulkiness, weight, or fragility.

5.2 The Company does not normally collect certain categories of Waste, including but not limited to asbestos, clinical or medical waste, chemical waste, solvents, liquids, gas cylinders, explosives, radioactive materials, and any other substances classified as hazardous under applicable legislation.

5.3 If, on arrival, the Company discovers that the Waste includes prohibited or hazardous items which were not disclosed at the time of Booking, the Company may refuse to remove those items and may charge the Customer for any costs or delays incurred.

5.4 The Customer warrants that the Waste presented for collection is not contaminated with hazardous substances, and that it is safe to handle using normal equipment and protective measures employed by the Company.

6. Pricing and Quotations

6.1 Prices for Services may be given as an estimate based on the information supplied by the Customer. The final price may vary depending on the actual volume, weight, and nature of the Waste and the time required to complete the job.

6.2 Where possible, the Company will confirm the final price on site once the Waste has been inspected. If the Customer does not agree to the revised price, the Company may cancel the Services, and a call-out or minimum charge may be applied.

6.3 Prices generally include loading, transport, and disposal charges but exclude any parking fees, congestion charges, or similar costs, which may be charged separately where applicable.

6.4 All prices are provided in pounds sterling and may be subject to value added tax or other applicable taxes, where required by law.

7. Payments

7.1 Unless otherwise agreed in writing, payment is due in full on completion of the Services, prior to departure of the Company’s team from the site.

7.2 The Company accepts payment by cash, debit card, credit card, or other methods expressly agreed in advance. The Company may require payment or a deposit before commencing the Services, particularly in relation to larger or commercial jobs.

7.3 Where the Customer has an approved account with the Company, payment terms will be as agreed in writing. If payment is not received by the due date, the Company may charge interest on the overdue amount at the statutory rate and may suspend or terminate further Services.

7.4 The Customer is responsible for all sums due under the Booking. If a third party has agreed to pay, the Customer remains liable if that third party fails to do so.

8. Cancellations and Amendments

8.1 The Customer may cancel or amend a Booking by giving reasonable notice to the Company. Cancellations should be made by telephone or email and must be acknowledged by the Company to be effective.

8.2 If the Customer cancels the Booking more than 24 hours before the agreed arrival time, no cancellation fee will normally be charged, unless the Company has incurred specific costs which it is unable to recover.

8.3 If the Customer cancels within 24 hours of the scheduled arrival time, the Company reserves the right to charge a cancellation fee, which may be up to a reasonable proportion of the quoted price, to cover administrative and lost appointment costs.

8.4 If the Customer is not present at the property or site at the scheduled time, or if access is not available and the Services cannot be carried out, this may be treated as a late cancellation, and a fee may be charged.

8.5 The Company may cancel or postpone a Booking at any time due to circumstances beyond its reasonable control, including adverse weather, vehicle breakdown, staff illness, safety issues, or legal or regulatory constraints. In such cases, the Company will seek to rearrange the Booking at a mutually convenient time and will not be liable for any indirect or consequential loss.

9. Customer Responsibilities

9.1 The Customer must ensure that the Waste is reasonably accessible, clearly identified, and separated from items not intended for removal. The Company will not be liable for removing items that the Customer failed to identify as not for disposal.

9.2 The Customer must obtain any necessary permissions from landlords, neighbours, building managers, or local authorities relating to the removal of Waste and the presence of the Company’s vehicles and staff on site.

9.3 The Customer must ensure that the area where the Services will be carried out is safe and free from hazards that could cause injury or damage. If the Company determines that conditions are unsafe, it may suspend or cancel the Services.

10. Liability and Damage

10.1 The Company will use reasonable care when carrying out the Services. However, the Customer accepts that the movement of heavy or bulky items, waste bags, and containers may carry some risk of minor damage to floors, walls, fixtures, or surfaces.

10.2 The Company will not be liable for any pre-existing damage or defects, or for damage caused by the fragile or unstable condition of items, surfaces, or access routes. The Customer should take reasonable steps to protect flooring and surfaces prior to the Company’s arrival where appropriate.

10.3 The Company’s total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the amount paid or payable by the Customer for the specific Booking in question, except where such limitation is not permitted by law.

10.4 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be excluded.

10.5 The Company will not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of goodwill, or loss of opportunity, arising out of or in connection with the Services.

11. Waste Regulations and Environmental Compliance

11.1 The Company will handle, transport, and dispose of Waste in accordance with applicable waste management legislation, environmental regulations, and relevant codes of practice in the United Kingdom.

11.2 The Customer acknowledges that the Company may use licensed waste transfer stations, recycling facilities, and disposal sites, and may separate recyclable materials where appropriate.

11.3 The Company may issue or rely on waste transfer notes or similar documentation as required by law. The Customer agrees to provide any necessary information to enable accurate description and classification of the Waste.

11.4 The Company is not responsible for any regulatory breaches arising from false, incomplete, or misleading information provided by the Customer regarding the type or origin of the Waste.

12. Ownership of Waste

12.1 By presenting Waste for collection and authorising its removal, the Customer warrants that they are the owner of the Waste or have the necessary authority to arrange its disposal.

12.2 Title to the Waste will transfer to the Company at the point of collection, subject to the Waste not being hazardous or prohibited. If prohibited or hazardous materials are later identified, the Company may require the Customer to take back such items or to reimburse the Company for any specialist handling and disposal costs.

13. Complaints

13.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as reasonably practicable, setting out the nature of the complaint and any relevant details.

13.2 The Company will investigate the complaint and, where appropriate, may request photographs, evidence, or the opportunity to revisit the site. The Company will seek to resolve complaints fairly and promptly.

14. Data Protection and Privacy

14.1 The Company may collect and process personal data relating to Customers for the purposes of managing Bookings, providing Services, processing payments, and handling customer service and legal obligations.

14.2 The Company will handle personal data in accordance with applicable data protection laws in the United Kingdom and will take reasonable measures to safeguard such information.

15. Changes to These Terms

15.1 The Company may update or amend these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated to Customers and will apply to new Bookings made after that date.

15.2 The Terms and Conditions applicable to a specific Booking are those in force at the time the Booking is confirmed.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services by the Company.

17. General Provisions

17.1 If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court or competent authority, such provision shall be severed to the extent necessary, and the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by the Company in exercising any right or remedy shall operate as a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.

17.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where necessary to provide the Services.

17.4 These Terms and Conditions, together with the Booking confirmation and any agreed written variations, constitute the entire agreement between the Company and the Customer in relation to the Services, and supersede any prior understandings or arrangements.
